Internet Registration Agreement
SSI Micro Ltd. (hereafter called ‘SSI’) will provide Internet access to the individual named in the Contact Information of this contract (hereafter called ‘Subscriber’) according to the terms outlined below:
SSI consents to the Subscriber having local access to the Internet through the use of its facilities, such use to be non-exclusive, and is also available to other SSI subscribers from time to time.
Reselling this Service or to otherwise make available to anyone outside the Premises the ability to use the Service, in whole or in part, directly or indirectly is strictly prohibited. The Service is for personal and non-commercial use only and you agree not to use the Service for operation as an Internet service provider or for any business enterprise or purpose. SSI reserves the right to terminate all services provided to the subscriber should these conditions be violated.
SSI’s residential service plan is strictly for personal use. SSI reserves the right to monitor subscribers account for usage and traffic. Subscribers found to be using the Residential plan for commercial use will be requested to upgrade their account to the appropriate corporate plan and will be billed the price difference. Subscriber agrees that they shall have no other recourse.
SSI agrees to supply the hook-up to the Internet, and a rental modem with the Subscriber being responsible for supplying all necessary equipment in working order for his/her computer & facilities, at the cost of the Subscriber.
Subscriber’s equipment must meet minimum system requirements.
Subscriber shall use the Modem in a careful and proper manner. Subscriber will not open the Modem or modify the normal operation and use of the modem. Subscriber will not remove any markings or labels from the modem indicating SSI’s ownership including serial and identification numbers. Subscriber will bear all risk of loss, damage, theft or destruction of the Modem. In the event of such loss or damage to the Modem, subscriber shall be liable for the cost of repair or replacement of the modem, the cost for replacement being $235.00 + GST.
Cancellation of Services by the subscriber must be done in person at SSI’s Yellowknife office. Subscriber must return the rental modem to SSI in order to close the account. Modems are on loan for the duration of the agreement between the subscriber and SSI and must be returned at the time of service cancellation. Failure to return your rental modem will result in a fee of $235.00 + GST. Service Cancellation must be done prior to billing which runs on the 15th of each month, SSI will not provide refunds or credits for partially used months.
SSI shall use its best efforts to supply access each day, however, should access not be available, the Subscriber shall have no recourse for a refund of any portion of the subscription fee and no credit of time or usage for any other day.
The subscriber agrees that SSI has full rights to monitor subscriber’s bandwidth consumption. SSI reserves the right to implement specific limits on the maximum amount of bandwidth consumption available to the Subscriber as set forth in SSI’s price list. If Subscriber exceeds the bandwidth consumption limits in any month, SSI has the right to charge subscriber excess bandwidth usage fees as set forth in SSI’s price schedule.
SSI reserves the right to make firmware upgrades to the modem at any time.
SSI reserves the right to terminate this agreement for any reason at any time. Should SSI have to cancel this Agreement, its liability shall be only to refund a portion, part of the remaining term of the subscription fee for the then current period.
A deposit is required for all modem rentals. SSI Accepts Visa, MasterCard or a $235 Cash deposit. Cheques are not accepted.
SSI shall not be responsible for any loss of information or time on the Internet, suffered by the Subscriber. The Subscriber assumes all such risk upon entering into this Agreement. The Subscriber agrees to pay all charges for Internet use levied by third parties.
Use of the Internet is solely the responsibility of the Subscriber and SSI shall have no liability for the nature of the data transferred.
The Subscriber shall not supply anyone else with his/her username name or password. Subscriber acknowledges that the master user name and password for their account provides access to the SSI customer portal where upgrades and changes to the subscriber’s account can be made and by giving out their username and password they do so at their own risk and are liable for all charges incurred on their account.
Fees for SSI’s Services must be paid by Credit Card, the first month to be paid in advance. Accounts that payment is declined on will automatically be suspended until payment in full is made. Overage charges and changes/upgrades to your accounts plan accrued during the month will automatically be billed to your credit card on a monthly basis at the rates published in our price schedule.
SSI is committed to protecting customers and the Internet community as a whole from Illegal, irresponsible and disruptive Internet activities. SSI is not obligated to but has the right to monitor the use of service. Email may only be sent to those who have requested it and must use a valid return E-mail address. If an SSI email address is referenced in spam originating from SSI’s servers, the responsible subscriber’s account will immediately be terminated. The distribution or use of mass emailing programs is strictly prohibited. Subscribers participating in but not limited to: advertising, transmitting, or otherwise making available any product, or service that is illegal or designed to solicit numerous responses, subscribing other Internet users to listservs or mailing lists, threatening other Internet users, mail bombing Internet users, running packet sniffers or port scanners or the intentional distribution of viruses and worms and other harmful files will result in immediate account termination and possible legal action. SSI reserves the right to terminate any account that engages in abuse of our systems, and/or other customer’s sites. This abuse includes, but is not limited to attempting to gain access to customer accounts or disrupting our systems in any way. No refund on services shall be provided. The subscriber acknowledges that they shall have no other recourse.
SSI respects your privacy. SSI may provide you with information about news, sales and promotions related specifically to SSI and SSI services as well as send you information regarding your account. SSI will NOT disclose your personal data outside of SSI unless we are required to do so by law and in order to assist in the detection or prevention of crime.
Subscriber may return wireless modem and cancel service within 72 hours of wireless registration for a complete refund of registration fee and month fee, provided the wireless modem is returned in working order, with all packaging material. SSI reserves the right to charge for usage during this 72 hour period at a rate of $15.00 per GB.
First Line Of Defense – Basic firewall service offers a basic level of protection against incoming connections from the Internet to your computer. Additionally, this service provides certain port filtering which will prevent harmful outbound connections from your computer, in the event that your computer has been compromised by a virus, worm, or other malicious software. Complete details of the filtering provided by our First Line of Defense service is available upon request.
SSI’s reserves the right to revise, amend, or modify this policy, and our other policies and agreements at any time and in any manner without notice. The subscribers continued use of the Service following the posting of such changes shall be deemed to be the subscriber’s acceptance of any such modification.
